Court Won't Hear Ozzy Osbourne Dispute

Two musicians who claim they've been cheated by rocker Ozzy Osbourne got no sympathy Monday from the Supreme Court.

Justices refused to consider the appeal of bassist Robert Daisley and drummer Lee Kerslake, who sued in 1998 seeking royalties for their work on Osbourne albums "Blizzard of Ozz" and "Diary of a Madman."

Los Angeles attorney Nate Kraut said his musician clients have been denied credit for writing songs that are now used in television commercials and during NFL games.

"Their music is literally everywhere," he told justices in a filing.

A California judge had dismissed the lawsuit that named Osbourne and his wife, as well as several music companies.

The case is Daisley v. Osbourne, 03-1289.

To bad for them, but to look on the bright side maybe Ozzy will get rid of those crap re-recorded versions of those two albums.

I wonder how many other lawsuits are keeping us from seeing or hearing some of Ozzy's older material. I would love to have Ultimate Ozzy on DVD, or any video of Randy on DVD. Who knows what all could be out there.

I dont fully understand their case, they say they never got paid for royalties? if they wrote the music, wouldnt they be entitled to it? Apparently there is more to the story.

Sharon Osbourne has categorically denied former Ozzy Osbourne bassist Bob Daisley's charge that she threatened his life, according to Launch Radio Networks.

Daisley said Sharon Osbourne "phoned me up and threatened my life!" in 1991 when he started questioning his royalty arrangement with his accountant, who was also working for the Osbournes at the time. Daisley and drummer Lee Kerslake have been suing the Osbournes for years over royalties and proper credit on the albums. Their latest suit was dismissed in California in 2002, and the dismissal was upheld by the U.S. Court Of Appeals last October. The musicians had filed an appeal of the dismissal with the U.S. Supreme Court, but the court declined to hear the motion.

Attorney Orin Snyder of the law firm of Manatt, Phelps & Phillips, who represents the Osbournes, released this statement to Launch: "Bob Daisley lost his case against the Osbournes. Mrs. Osbourne categorically denies (Daisley's) accusations, which she believes are nothing more than

I got Blizzard Of Ozz.
I read in the booklet that Bob Daisley and Lee Kerslake are respectively the original bassist and drummer of the album. The booklet also says that the drumming and bass I'll hear on the record will have been performed by Mike ("who the fuck is") Bordin and Robert Trujillo (Metallica I think).

I have no idea why you'd wanna do that... unless the original bass and drums sucked, but I have doubts about that.
I'm listening to the album on youtube since I have no CD player in Paris.

My first impression is that Ozzy ripped off those two dudes.
And... as soon as I read that the bass and drums were completely re-recorded, I just knew that I'd find out that shit hit the fan if I searched google... an here I am!
